Do Freelancers Need to Charge Sales Tax in the US?
Sometimes yes, often no, and annoyingly: it depends. US freelancers do not charge sales tax simply because they sent an invoice. Sales tax depends on the state, what you sell, where your customer is, and whether your business has a tax obligation there.

The short answer

Freelancers usually need to think about sales tax when they sell taxable goods, taxable digital products, or taxable services in a state where they are required to collect tax. Many freelance services are not taxable in many states, but that is not universal.

Three questions decide most cases

  • What are you selling? Writing, design, consulting, repairs, physical products and software can be treated differently.

  • Where is the customer? Some state rules depend on the destination of the sale.

  • Do you have nexus? Physical presence or enough sales into a state can create an obligation to collect tax.

Services vs products

A freelance designer selling strategy work is not in the same position as a designer selling printed merchandise. A developer selling custom consulting is not always in the same position as a developer selling software subscriptions. The category matters.

If your work includes both labour and materials, separate them clearly. That gives you and your accountant a better starting point if tax treatment differs.

How to show sales tax on the invoice

If you are required to collect sales tax, show it clearly as its own line. Do not bury it in the total.

Line

Example

Subtotal

$1,000.00

Sales tax

$82.50

Total due

$1,082.50

What not to do

  • Do not add sales tax just because it feels professional.

  • Do not skip tax because the client is in another state without checking nexus rules.

  • Do not describe sales tax vaguely as an admin fee.

  • Do not rely on old advice if you sell digital products or remote services.

A safer workflow

Create invoices consistently, keep clean records, and review tax treatment by state when you enter a new market or start selling a new type of offer. Clervo helps with the invoice and payment trail; your state tax agency or tax professional helps with the tax answer.
